1. Overview

This website is operated by Festwick ("we", "us", "our"). By visiting our site or purchasing from us, you engage in our Service and agree to be bound by these Terms of Service, including the additional terms and policies referenced here and available by link — our Shipping Policy, Refund Policy and Privacy Policy. If you do not agree to these terms, please do not use this site.

2. Eligibility

You must be at least the age of majority in your state or province to use this site, and you may not use our products for any illegal or unauthorised purpose.

3. Products and pricing

We have made every effort to display our products and their colours accurately, but we cannot guarantee that your screen displays colour exactly. Prices are shown in US dollars and are subject to change without notice. We reserve the right to limit quantities, refuse any order, or discontinue any product at any time.

Where a product is shown with a compare-at price, that figure is the price at which we offer the item outside of a promotional period.

4. Product use and safety

Heated garments. Our heated garments are designed as indoor comfort layers. Please read and follow the instructions supplied with the product, including those covering charging, cleaning, and supervision during use. Do not use a heated garment that shows damage to its wiring, controller, or connectors. Heated products are not intended for use by children, or by anyone unable to respond to discomfort from heat, without supervision. If you have a medical condition that affects your sensitivity to temperature or your circulation, consult a physician before use.

Seasonal décor. Our Halloween and Christmas décor (for example the GlowSwing™ and the Hairy Spider) is decorative and is not a toy. Hang items only from a branch, beam, hook or stand that can safely carry the weight, and out of the reach of small children. Use battery-powered lights only with the battery type stated in the instructions, and remove the batteries before storing. Remotes and button-cell batteries must be kept away from children. "Weather-resistant" means suitable for a covered porch or garden in normal conditions — it is not waterproof; bring items indoors during heavy rain, snow or strong wind.

5. Bundle offers and free gifts

Bundle prices and free gifts are applied automatically in the cart when the qualifying quantity is selected. The "value" shown for a free gift is the price at which we list that item for sale on this site. Free gifts have no cash value, cannot be exchanged for money or other products, and may be substituted or withdrawn while stocks last. Digital items are delivered by email to the address given at checkout.

6. Orders and accuracy of information

You agree to provide current, complete and accurate purchase and account information for all purchases. We reserve the right to refuse or cancel any order that we believe has been placed fraudulently, or where the product was listed at an incorrect price.

7. Errors and omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, or availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice.

8. Third-party links

Our site may include links to third-party websites that are not controlled by us. We are not responsible for the content or accuracy of those sites, and their inclusion does not imply endorsement.

9. Limitation of liability

To the fullest extent permitted by law, Festwick shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Service or any product purchased through it. Where liability cannot be excluded, it is limited to the value of the product purchased. Nothing in these terms limits any rights you have under applicable consumer protection law.

10. Indemnification

You agree to indemnify and hold harmless Festwick from any claim or demand made by any third party arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

11. Governing law

These Terms of Service are governed by the laws of the State of Florida, United States.
